Definitions
These Terms use the following words with these meanings, unless a product page or licence summary states a more specific meaning for a purchase.
Product
A digital item sold by HyperDAF on this platform — a WordPress theme, plugin, template, SaaS tool, bundle or extension — as described on its product page.
Licence
The limited permission to use a product under these Terms and the scope shown for the purchased licence. A purchase grants a licence; it does not transfer ownership of the product.
Licence key
The unique key issued for a purchase and tied to that order and to the buyer account. The key identifies the licence for activation, verification and update delivery.
Activation
Registering a licence key for use. An activation records the site or environment the key is used on so the licence can be verified.
Order
A purchase record created when an order is accepted: payment is confirmed and the eligible product or service is made available.
Account
The registered customer record used to sign in and to access purchases, downloads, licences and support.
Acceptance and eligibility
By accessing HyperDAF, creating an account, purchasing a product or using a service, you agree to these Terms and any product-specific licence or plan terms presented at purchase.
Legal capacity
You must be legally able to enter a binding agreement in your jurisdiction. If you act for an organization, you confirm that you have authority to bind it.
Business and consumer use
These Terms apply to both business and consumer customers, subject to rights that cannot lawfully be excluded or limited.
Product-specific terms
A product page, licence summary, plan summary or checkout notice may contain additional terms. Where they conflict, the more specific term controls for that item.
Accounts and customer responsibilities
Accounts are personal to the registered customer or authorized organization and must be used accurately and securely.
Accurate information
Provide current, complete and accurate account, billing and contact information and update it when it changes.
Credential security
Protect passwords, sign-in links, licence keys and account recovery methods. Notify HyperDAF promptly if you suspect unauthorized access.
Authorized activity
You are responsible for activity performed through your account unless applicable law requires otherwise. Do not share an account in a way that defeats licence, seat or plan limits.
Account communications
Operational, security, order, licence and legal notices may be sent to the email address associated with your account.
First-party products and platform role
HyperDAF sells only products designed, developed, published and supported by HyperDAF. It is not a marketplace for second- or third-party sellers.
WordPress themes
Theme licences grant the limited installation and use rights described on the relevant product page and licence summary.
WordPress plugins
Plugin functionality, compatibility, activation limits and update eligibility are governed by the purchased licence.
Templates and digital assets
Templates may be customized for permitted projects but may not be redistributed as standalone source files or competing libraries.
SaaS tools
Hosted tools are provided under the selected plan, its usage limits and its availability conditions.
HyperDAF does not authorize independent sellers to list products on this platform. Product descriptions, delivery, licences, updates and support are provided directly by HyperDAF.
Orders, pricing, taxes and payment
Orders are offers to purchase the selected product or plan. An order is accepted when HyperDAF confirms payment and makes the eligible product or service available.
Prices and currency
Displayed prices, currency, discounts and included features apply at the time of checkout unless an obvious error is identified before fulfilment.
Taxes and charges
Applicable taxes, payment-provider charges or legally required fees may be calculated at checkout or handled by the configured payment provider.
Payment authorization
You authorize the selected payment provider to process the amount shown at checkout. Payment providers operate under their own terms and security controls.
Order review and fraud checks
HyperDAF may delay, reject or cancel an order reasonably suspected of fraud, abuse, pricing error, sanctions risk or unauthorized payment.
Receipts and records
Order confirmations and receipts are provided electronically. Keep account and order information for licence, update, support and accounting purposes.
Tax treatment
Unless a product page or the checkout states otherwise, displayed prices do not include taxes. Where a tax applies to a purchase, it is calculated and shown at checkout before payment is taken; no tax is added to an order after it has been confirmed.
Digital-product licences
A purchase grants a limited, non-exclusive, non-transferable licence to use the product within the scope shown for the purchased licence. Ownership of the product and intellectual property does not transfer.
Permitted uses
- Install and use the product on the number of websites, projects, users or environments allowed by the purchased licence.
- Modify permitted source files for your own licensed implementation or client project.
- Create end products that incorporate templates or assets where the original files cannot be extracted or redistributed.
- Maintain reasonable backup copies solely for licensed use and disaster recovery.
Prohibited uses
- Do not resell, sublicense, share, publish or distribute the product or licence key as a standalone item.
- Do not remove ownership notices or represent HyperDAF products as your independently authored product.
- Do not bypass activation, seat, site, usage or technical protection limits.
- Do not use the product to create a competing theme, plugin, template library, SaaS service or redistribution repository.
- Do not make the product available through file-sharing, public source repositories or unauthorized download services.
HyperDAF and its licensors retain all right, title and interest in product code, designs, documentation, trademarks and related intellectual property, except for the limited rights expressly granted to you.
A licence may not be transferred, assigned or sold without HyperDAF’s prior written approval, except where a product-specific licence expressly permits client assignment.
Delivery, updates, compatibility and support
Digital delivery and service access depend on successful payment, account status, product availability and the technical requirements stated for the product.
Digital delivery
Eligible downloads or access instructions are provided through the customer account, secure receipt link or configured delivery method after payment confirmation.
Updates
Updates are provided for the period and products covered by the active licence or plan. HyperDAF may modify, replace or discontinue features while maintaining applicable commitments.
Compatibility
You are responsible for checking published WordPress, PHP, browser, hosting and third-party integration requirements before purchase and installation.
Support scope
Support covers documented product functionality and eligible defects during the support period. Custom development, unrelated server issues and unsupported third-party conflicts may be excluded.
SaaS plans and hosted services
Hosted HyperDAF tools are sold for a one-time payment and may also be offered free or on trial where stated. Plan-specific limits and the terms shown at purchase form part of these Terms.
Plan limits
Use must remain within the users, projects, storage, API, automation, traffic or other limits stated for the plan.
One-time billing
Each SaaS plan is paid for once, at purchase. No recurring payment is taken, and no further charge is made unless you buy another product or plan.
Trials and promotions
Trials and promotions may have eligibility, duration, feature and conversion conditions. Abuse or repeated trial creation may be restricted.
Cancellation
You may stop using a SaaS tool at any time. Because the plan was paid for once, there is no renewal to cancel; purchased access continues under these Terms unless termination is required for security or abuse.
Service changes
HyperDAF may update plans, limits or features with reasonable notice where required. Material pricing changes apply prospectively unless law permits otherwise.
User content, reviews and feedback
You retain ownership of content you submit, subject to the limited permissions needed for HyperDAF to host, display, process and support that content.
Lawful content
Do not submit content that is unlawful, infringing, deceptive, abusive, malicious, confidential without authority or harmful to other users or systems.
Platform licence
You grant HyperDAF the limited worldwide rights necessary to store, process, reproduce and display submitted content for operating and improving the requested platform features.
Feedback
Ideas, suggestions and feedback may be used by HyperDAF without restriction or payment, provided no confidential information or third-party rights are improperly included.
Acceptable use and prohibited conduct
Use HyperDAF products and services lawfully, responsibly and within documented technical limits.
- Do not interfere with platform security, availability, authentication, rate limits or technical safeguards.
- Do not upload malware, exploit code, destructive payloads or content intended to compromise systems or users.
- Do not scrape, crawl, probe or automate access beyond published interfaces or written authorization.
- Do not impersonate others, conduct fraud, evade sanctions or misuse payment, account or licence systems.
- Do not use HyperDAF products or services to violate law, privacy, intellectual-property rights or contractual obligations.
- Do not overload shared infrastructure, abuse support channels or use resources in a way that materially harms other customers.
Security research, penetration testing or vulnerability scanning requires prior written authorization unless a published HyperDAF security policy expressly permits the activity.
Third-party services and integrations
HyperDAF products may connect to hosting providers, payment processors, WordPress, browsers, APIs or other third-party services. Those services are independent and governed by their own terms.
You are responsible for obtaining and maintaining required third-party accounts, licences, permissions and compatible environments. HyperDAF does not control third-party availability, policies or changes.
Links to third-party resources are provided for convenience and do not imply endorsement, responsibility or a warranty regarding external content or services.
Availability, warranties and disclaimers
HyperDAF aims to provide reliable first-party products and services, but software and online services cannot be guaranteed to operate without interruption, defects or compatibility changes.
Service availability
Maintenance, security events, infrastructure failures, third-party outages, legal requirements or product changes may temporarily limit access. Where practical, HyperDAF may provide status information or notice.
Beta and preview features
Beta, preview, experimental or free features may be changed, suspended or withdrawn and may have reduced support, availability or data-retention commitments.
To the maximum extent permitted by law, products and services are provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, non-infringement or uninterrupted operation. Product-specific express warranties and non-excludable statutory rights remain unaffected.
Liability and indemnity
Liability is allocated in a manner intended to be reasonable for digital products and online services, subject to rights and liabilities that cannot lawfully be excluded.
Excluded losses
To the extent permitted by law, HyperDAF is not liable for indirect, incidental, special, exemplary or consequential loss, or for lost profits, revenue, data, goodwill or business opportunity arising from use or inability to use a product or service.
Liability cap
Where a monetary cap is legally permitted, HyperDAF’s aggregate liability relating to a product or service will not exceed the amount paid for that product or service during the twelve months preceding the event giving rise to the claim.
Business-user indemnity
To the extent permitted by law, business users agree to defend and indemnify HyperDAF against third-party claims arising from their unlawful use, submitted content, licence violation or breach of these Terms. Consumer rights are not reduced by this clause.
Suspension and termination
HyperDAF may restrict, suspend or terminate access where reasonably necessary to protect users, enforce licences, prevent abuse, comply with law or address non-payment.
Reasons for action
Examples include material breach, fraud, security risk, prohibited conduct, repeated payment failure, sanctions restrictions or unauthorized product distribution.
Notice and cure
Where appropriate and legally permitted, HyperDAF may provide notice and a reasonable opportunity to correct a breach before termination. Immediate action may be taken for urgent security, fraud or legal reasons.
Effects of termination
Termination may end account access, downloads, updates, support, hosted services and licence activation. Provisions that by nature should survive will remain effective.
Customer termination
You may stop using the platform and request account closure subject to outstanding obligations, retention requirements and product-specific rules.
Refunds, cancellations and statutory rights
Refund eligibility is governed by the published Refund Policy, product-specific commitments, payment-provider rules and applicable consumer law. Nothing in these Terms excludes mandatory cancellation, refund or remedy rights.
If a chargeback or payment dispute is opened for a transaction, the direct refund review for that same transaction is paused while the payment provider decides the dispute, and the related licence may be suspended or revoked. Contact HyperDAF first so a refund can be reviewed without a dispute.
Changes to products and these Terms
HyperDAF may update these Terms to reflect product, legal, security or operational changes. The effective and reviewed dates should be updated, and material changes may be communicated through account, email or platform notices where required.
Continued use after revised Terms take effect constitutes acceptance where permitted. If you do not agree, stop using the affected service before the new terms apply.
Governing law and disputes
These Terms are governed by the laws specified by HyperDAF for its operating entity, excluding conflict-of-law rules, while preserving mandatory consumer protections that apply in your place of residence.
Jurisdiction
Courts or dispute forums with lawful jurisdiction over the relevant HyperDAF operating entity will hear disputes, unless applicable consumer law grants another mandatory forum.
Informal resolution
Before filing a formal claim, contact HyperDAF with a clear description and requested resolution so the parties can attempt to resolve the issue informally within a reasonable period.
Mandatory consumer rights
Nothing in these Terms limits rights, remedies, warranties or liabilities that cannot legally be excluded or restricted under applicable consumer, data-protection or other mandatory law.
Questions about these Terms
Contact HyperDAF for questions about account obligations, licences, purchases or these Terms. Include the relevant product and order reference, but never send passwords, secret keys or payment-card details.
Terms and legal enquiries are routed to the appropriate HyperDAF contact for review.
